Chris Carr Urges the Supreme Court to Throw Out Colorado’s Energy Lawsuit

“One city does not have the right to dictate energy policy for the entire country."

Attorney General Chris Carr is urging the U.S. Supreme Court to throw out a lawsuit brought by Boulder County and the City of Boulder, Colorado, against major oil and gas producers. 

The amicus brief, filed in the Supreme Court case Suncor Energy v. Boulder County, essentially argues that allowing a Colorado locality to hold the entire energy industry liable for ‘global climate change’ under state law would unconstitutionally allow one jurisdiction to dictate national energy policy.

Should this precedent be set, it would deal a devastating blow to states that depend on traditional energy production. 

AG Carr lambasted the suit and the idea that any one locality can dictate policy for the whole country. He then criticized the ‘Left’ for its obsession with engaging in climate warfare that only serves to drive up costs for consumers. 

“One city does not have the right to dictate energy policy for the entire country, and attempting to do so is blatantly illegal,” said AG Carr. “The Left’s obsession with climate warfare will only lead to higher costs and lost jobs.”

He continued, “That’s why we’re pushing back and fighting for safe, reliable, and affordable energy for all Americans.” 

The Brief and Its Context

This brief is the latest in a series of steps AG Carr has taken to protect Georgia’s energy interests and lower consumers’ costs. 

In addition to filing lawsuits against Vermont and New York over their superfund laws, the Attorney General has joined coalitions to stop regulatory overreach by federal agencies and other states. 

The amicus brief was originally filed to the Supreme Court by the attorneys general of West Virginia and Alabama. 

Carr is joined in this support by the attorneys general of the following states: Alaska, Arkansas, Florida, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Texas, Utah, and Wyoming.
