Chris Carr Warns Businesses to Comply Gas Tax Suspension or Face Prosecution

As Georgia enters into the second week of its gas tax suspension, Attorney General Chris Carr is warning businesses that any failure to comply will result in an investigation and potential prosecution.

In a statement, AG Carr commended Governor Brian Kemp (R-GA) and the General Assembly, calling the suspension a ‘critical measure.’ He reiterated his warning and clarified that this is all an effort to protect Georgia consumers from exploitation. 

“We commend Governor Kemp and our partners in the legislature for passing this critical measure to lower costs at the pump,” said AG Carr. “Any business that purposefully fails to comply with the law will be investigated immediately, and we will not hesitate to prosecute if warranted. Now is not the time to play games at the expense of Georgia consumers.”

For Context

On March 20, 2026, Gov. Kemp signed House Bill 1199 into law, suspending, for 60 days, the excise tax on motor fuel provided by Georgia law. The suspension became effective on the same day and applies to both diesel fuel and motor fuel. 

Prices at the pump will begin to reflect this change in the coming days and weeks as retailers receive new shipments of motor fuel. Georgia's excise tax on gasoline is currently 33.3 cents per gallon, and on diesel, 37.3 cents per gallon.

This suspension is expected to save Georgians $400 million over the next two months and is paired with a flurry of recent tax reforms headed by the General Assembly.

The failure of businesses to pass the associated savings on to customers could constitute an unfair or deceptive act, which the Attorney General has the authority to investigate and prosecute according to the Official Code of Georgia Annotated, §§ 10-1-390 through 408.
